These Terms of Use ("Terms") govern the use of the BreathLife mobile application ("the Application") published by YVAD ONLINE, an EURL registered under SIRET 484 394 036 00046, with its registered office at 229 Rue Saint-Honoré, 75001 Paris, France.

By downloading, installing, or using the Application, you agree to these Terms without reservation. If you do not accept these terms, please do not use the Application.

1. Description of Service

BreathLife is a wellness application offering guided breathing exercises, a CO₂ tolerance test to evaluate breathing capacity, progress tracking, a gamification system (badges, stars, streaks), and community features.

2. Access to the Application

The Application is available for download on the App Store (Apple). Using the Application requires an internet connection and a compatible device.

Some features are accessible for free. Additional features are available through a Premium subscription.

3. Account Creation

To use the Application, you must create an account by providing accurate and complete information. You are responsible for the confidentiality of your login credentials and all activity under your account.

You agree to immediately notify us of any unauthorized use of your account at contact@breathlife.app.

4. Subscriptions and In-App Purchases

4.1. Premium Subscription

The Application offers Premium subscriptions that unlock additional features (advanced exercises, detailed tracking, extended community features).

4.2. Billing

  • Payments are processed by Apple via the App Store.
  • The subscription automatically renews at the end of each period unless canceled.
  • Prices are displayed in the Application and may vary by country and currency.

4.3. Cancellation

  • You can cancel your subscription at any time through your App Store account settings.
  • Cancellation takes effect at the end of the current subscription period.
  • No refunds are provided for the current period, in accordance with Apple's policies.

4.4. Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless canceled beforehand.

5. Acceptable Use

You agree not to:

  • Use the Application for illegal or unauthorized purposes
  • Attempt to circumvent the Application's security measures
  • Copy, modify, distribute, or decompile the Application or its content
  • Harass, threaten, or harm other users through community features
  • Publish inappropriate, offensive, or illegal content
  • Create fake accounts or impersonate others

6. Medical Disclaimer

The BreathLife Application is not a medical device and does not provide medical advice. The breathing exercises offered are for informational and wellness purposes only.

  • Consult a healthcare professional before starting any breathing program if you have pre-existing medical conditions.
  • Stop any exercise immediately if you experience discomfort, dizziness, or feel unwell.
  • The Application does not replace medical treatment or monitoring by a healthcare professional.

7. Intellectual Property

The Application, its content (texts, images, sounds, exercises, algorithms), and its brand are the exclusive property of YVAD ONLINE and are protected by intellectual property laws. Any unauthorized reproduction is prohibited.

8. User-Generated Content

By using community features, you grant YVAD ONLINE a non-exclusive, worldwide, royalty-free license to use, display, and distribute content you post within the Application.

We reserve the right to remove any content that violates these Terms or is deemed inappropriate.

9. Limitation of Liability

The Application is provided "as is." YVAD ONLINE does not guarantee that the Application will be free of errors, interruptions, or defects.

To the extent permitted by law, YVAD ONLINE shall not be liable for:

  • Direct or indirect damages resulting from the use of the Application
  • Loss of data
  • Service interruptions
  • Any health issues related to practicing breathing exercises

10. Suspension and Termination

We may suspend or terminate your access to the Application in case of violation of these Terms, without prior notice or compensation.

You may delete your account at any time from the Application settings or by contacting contact@breathlife.app.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified through the Application. Continued use of the Application after modification constitutes acceptance of the new Terms.

12. Applicable Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to the interpretation or execution of these Terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
